In a Chapter 7 bankruptcy, the debtor turns over his nonexempt property, if any exists, to a trustee who then converts the property to cash to pay the debtor's creditors. In return, the debtor receives a discharge of his debts. Not all debts are dischargeable. Certain debts, by law, will not be discharged. These include most tax debts, debts for obtaining money, property, or credit by means of fraud or false financial statements, debts for alimony, child support, and other divorce-related debts, debts for most student loans, debts for personal injury or death caused by the debtor while intoxicated, and debts for certain fines and penalties.
Means testing is the method of determining an individual's eligibility to maintain a Chapter 7 case. It determines whether your income is low enough for you to qualify for a Chapter 7. The test was created to limit the filing of a Chapter 7 to only those individuals who really cannot pay their debts. By deducting specific monthly expenses from your monthly income, the means test arrives at a monthly figure called disposable income. If your disposable income is too high, you will not be able to file for a Chapter 7 bankruptcy.
